URGENT, HELP NEEDED

We desperately need user evidence to support our DMMO claims, if you have used any of the following lanes please write to KCC and tell them so.
For example

Statement of Use of the Road Used as a Public Path (RUPP) ER179 Alkham, Kent.

I can confirm that I have used this public right of way on bona fide journeys on many occasions between 1995 and 2005 using a trail motorcycle. I have always understood this lane to have vehicular rights; I have never been challenged about my use of this lane. The lane has never been blocked or sign posted to indicate that vehicular use is not allowed.

Again, if you hear of these bikes (or parts) being offered cheap or see such bikes being ridden by oiks then please contact the police asap. More details later.

Post-NERC

Sorry about the delay in updating the site, but the NERC Act has created a few shock waves around here!
To clarify what's happened read Degsy's synopsis here. It's an excellent review and well worth a read.

NERC Act is done...

The NERC Act was passed on 30th March. This means that the saying "once a highway, always a highway", a basic of highway law for the last few hundred years, is now cancelled. Most RUPPs will become out-of-bounds to the legal trail rider as the claims to correctly classify as BOAT that were put in recently have now been rendered useless. As trail riders we have been well and truly stitched up by this government, led by the lies of groups who would ban us completely from the countryside. However, all BOATs are still available to us, that is apart from the ones with TROs on them. Fight this awful injustice by joining the TRF to give them the funds to challenge this new law and to support you in this time of legal confusion.

Clause 62 of NERC Bill is due to be heard in the House of Lords on Feb 27th.

This will be a discussion about the loss (to us) of many of the trails we use in Kent, and many, many more around the country. DEFRA are insistent that the NERC Act will not remove any of our rights, but many trails we use in Kent are not marked as a Byway, so we are faced with losing them. They are lying to us. BUT - has the hunting act stopped fox-hunting? Has the gun act stopped people being shot? Will the smoking act stop people smoking in public places? Will the NERC act stop trail riding?

Adisham Lanes - Total TRO!!

KCC impose total ban on use of 2 major lanes in Adisham (Cooting Downs for those that know the area). These lanes are closed to all users (vehicles, horses and walkers) until further notice. Even the local landholders have been asked to desist...
Reason? "there is a serious risk of injury to users of the Byway at present (particularly those on horseback)". It has also been acknowledged that a lot of the damage has been done by agricultural vehicles.
Check out last year's review of these lanes - I think you'll find it very informative. What do you think the KCC should do? Hard surface the lot?
